• E1 Treaty Trader Visa

The E1 treaty program is a non-immigrant visa. It is issued to foreigners from nations that have existing commerce and navigation treaties or strong bilateral agreements on these lines. There are several requirements for qualifying for the E1 Visa:

• E2 Treaty Investor Visa

The E2 treaty investor visa program is also a non-immigrant visa program. It is issued to foreigners from countries that have existing trade and navigation treaties. It is designed to facilitate investment in the country by allowing applicants to invest in and oversee a business. However, the investment must be substantial and must benefit the U.S. just as much as it benefits the investor. 

Some of the requirements for qualifying for the E2 Visa are:

• The investor can be corporate or a real person, but must also be a citizen of the treaty investor country
• The investment must be substantial and enough to ensure the success of the undertaking
• If you invest in a low-cost enterprise, then the investment percentage must be higher than for a high-cost enterprise
• The investment must be in an existing enterprise – speculative investments are prohibited
• The investment must have tangible benefits for both the U.S. and the investor; it must not be marginal. This means that it must provide more income than needed for the investor’s living
• The investor must be the holder of the funds invested – he/she should have obtained the funds legitimately. This means that investments made using loans taken through the enterprise’s assets are not permitted
• You must hold one of three positions: be the principal investor, be an employee of the investor appointed to supervise the investment, or possess highly specialized skills that are required for the investment
• The investment must be at risk and should be irrevocable

Just like the E1 visa, the E2 visa allows you to reside in the country as long as you are involved in overseeing the investment. The visa is valid for two years and can always be renewed. It also comes with most of the privileges of the E1 visa including bringing your spouse and children with you and traveling in and out of the country as much as you wish. 

• E3 Visa

The U.S. maintains certain special ties with Australia, and the E3 visa program is designed to facilitate these relations. That is why this visa program is exclusive to Australian nationals only. 

The E3 visa is dubbed the “Specialty Occupation Professionals for Australia” visa program. It is issued to Australians who possess special skills and are seeking to engage in specialty occupation in the U.S.A. Some of the requirements include being a holder of a degree (or an equivalent or higher certification) and being actively engaged in a specialty occupation. 

Some of the privileges of this visa include the option of moving your spouse and dependent children into the country. However, the visa is valid for only as long as you are engaged in the specialty occupation as it is a non-immigrant visa.
